Information about the processing of your personal data and your rights.

Privacy policy effective since March 28, 2020.

At Maldita.es we fight against disinformation relying on our community of malditos and malditas, technology and education. Our principles defend transparency, confidentiality and security. Consequently, below we provide you with all the information related to the processing of personal data that we may collect from visitors to our website and/or users of our services.

1. Who is responsible for processing your data?

Hereinafter we will refer to both controllers jointly as MALDITA.

2. When do we collect your personal data?

At MALDITA we may collect your personal data at the following times:

  • When you register as a maldit@: if you decide to collaborate with us and become a maldit@ you will have to fill out a registration form in which we will ask you for personal information. Once registered you will have a profile and if you wish, you can collaborate with your superpowers against disinformation, sharing with us information about your profession and your abilities or passions.
  • When you register as an ambassador: we need your help to continue being an independent media, if you decide to give us your financial support in the form of a donation to the Maldita.es Foundation you can register as an ambassador, for this we request personal data and data related to payment.
  • Through emails or contact forms: you can contact us by sending us an email to [email protected] or using one of our contact forms that we make available to you. Remember that if you want to send an email completely anonymously you have a secure mailbox, you will find more information about this mailbox at this link.
  • Through the direct WhatsApp service: you can register for our WhatsApp service to receive debunks directly on your mobile. For this we will require you to provide us with your phone number.
  • When you register for our newsletters: if you request to receive any of our newsletters by email, know that when you register we will request your contact information to be able to send it.
  • Through our social networks (Twitter, Facebook or Instagram).
  • Through cookies: our website installs cookies that collect information about browsing, we recommend that you read the cookie policy for complete information on this matter.

3. For what purpose do we process your personal data?

When you register as a maldit@ or ambassador we will use your data to create a profile with your data from which you can access and provide new data and manage the data provided and the services you have registered for. If you inform us of your superpowers we may contact you to request your collaboration on a topic in which we need your expert advice. In the case of ambassadors, we will process your data to manage the payments of the contributions you have decided to make to the Maldita.es Foundation. We may also use your data to keep you informed of our activities, services and news.

If you send us an email or use one of our contact forms we will use your data to manage your request, respond to you and/or resolve the question or query you raise.

If you register for our WhatsApp service we will use your data to send you debunks and information about our services and news directly to your mobile, as indicated when you register for the service.

If you register for one of our newsletters your data will be used to send you the newsletter.

When you request it yourself, we may process your data to send it to NGOs or other associations with which we collaborate and which may be of interest to you, in those cases you can consult the privacy policy of the collaborator before making the request.

4. What is the legal basis for processing your personal data?

The main legal basis for processing your data is the consent that you yourself give us when registering, requesting our services or contacting us.

We may also process personal data based on the execution of a contract when we assume some mutual commitment, and of course if applicable, we will process your data for compliance with legal obligations, such as those derived from the financial contributions that our ambassadors make to the Maldita.es Foundation.

Finally, we may process your data based on legitimate interest to send you our own communications informing you of our news and activities.

5. How long will we keep your personal data?

At MALDITA we will process your personal data for the time necessary to fulfill the purposes mentioned above, as well as to keep your personal information in compliance with the provisions of the relevant laws and regulations, especially in relation to legal limitation periods, and for the formulation, exercise or defense of claims.

The criteria we follow for this is determined by (a) the purpose of the data collected and the fulfillment of that purpose; (b) the reasons for which the data is collected: e.g., in case of consent, you may revoke it at any time, and (c) mandatory storage periods according to contractual and regulatory requirements.

Keep in mind that in some cases we may keep your data for the time necessary for the formulation, exercise or defense of claims, requirements, responsibilities and legal, contractual or ethical obligations, always being properly blocked.

6. What if the data belongs to a minor?

Ambassadors can only be adults. We consider that neither the content of the platform nor the activity we carry out is aimed at a child audience, however, we like having teenagers who interact with us. That is why only people over 14 years of age (14 years included) are allowed to register and use our services and it is not expected that minors under 14 years of age contact us or give us their data. In any case, if you are parents or legal representatives and you consider that your children or wards have sent us personal data, we ask that you contact us by sending an email to [email protected]

7. To which recipients can your data be communicated?

Your personal data will be processed by the MALDITA team at our facilities and it is not planned to communicate them to third parties unless it is necessary to provide the service or to comply with legal obligations. In the case of ambassadors, the data will be communicated to the tax administration and to the corresponding financial entities to manage the payment.

We collaborate with third parties, usually NGOs and associations to which we may send your data whenever you have requested it. In each case, we will make available to you the privacy policy of the third party so that you know in advance how they will process your data.

We inform you that by hosting your data in our system your data will be processed by service providers who act as data processors, with whom we sign the relevant data processing contract.

8. What are your rights when you provide us with personal data?

If we process your data you should know that your rights are:

  • Right to request access to personal data: you may ask us if we are processing your data, and if so, access them.
  • Right to request rectification if the data is inaccurate, or complete the data we have incomplete.
  • Right to request the deletion of your data.
  • Right to request limitation of processing: in this case, we will only keep them for the exercise or defense of claims.
  • Right to object to processing: we will stop processing personal data, with the exception that they must continue to be processed for legitimate reasons or for the exercise or defense of possible claims.
  • Right to data portability: in case you want your data to be processed by another data controller, we will facilitate the transfer of your data to the new controller, whenever technically possible.
  • Right not to be subject to a decision based solely on automated processing of your personal data.

At MALDITA we process data based on your consent, we inform you that you can withdraw it at any time, without affecting the legality of the processing based on consent prior to its withdrawal.

If you have not obtained satisfaction in the exercise of your rights, you can file a complaint with the competent data protection authority (in Spain, https://www.aepd.es).

Remember that you are responsible for the data you provide us, therefore, your data must be truthful, accurate and you must keep it updated.

9. Modifications

At MALDITA we will only use your personal data as established in this Privacy Policy, which is in force at the time we collect your information. In the event that we make a modification to the processing of your data, you will be informed in a timely manner.
